“We have become an arbitration nation,” one court has said, but the rapidly expanding field of commercial arbitration remains a mystery to many practitioners. Please join us for a panel presentation moderated by Justice Rebecca Kourlis, in which our panelists—all Fellows in the College of Commercial Arbitrators—will discuss arbitration best practices, tips and tricks for navigating the commercial arbitration process from beginning to end, cautionary tales for the unwary advocate, and how to explore becoming an arbitrator yourself. The panel will also explore a number of ethical considerations in arbitration, including the role of ethics in selecting an arbitrator, an attorney’s duty to their client in the context of arbitration (and how this differs from the conventional litigation process), ethical guidelines bearing on the relationships between attorneys and arbitrators in arbitration, and the ways in which “confidentiality” may differ in arbitration versus in the more public theater of court. As part of their materials, the panel will also provide the Code of Ethics for Arbitrators in Commercial Disputes, and will refer to its canons during the ethics component of its presentation.
