  • The last decade has seen huge leaps in eDiscovery best practices, including in technology assisted review (TAR).  This CLE will look at current best practices for conducting a review of large document collections, beyond simply using search terms.  This will include determining the review scope, negotiating an ESI protocol, engaging in an early case assessment, and knowing the limits of an early case assessment, working through review, and handling privilege logs for large productions. It will couple a discussion of the practical mechanics of a document review with discussion of recent district court options on the use of TAR/AI review tools.
