Algorithm is Gonna Get You: Antitrust Risks with Information-Sharing Software

Antitrust lawsuits targeting information-sharing software have become prominent in the last several years. Private plaintiffs and government enforcers have targeted a variety of industries, including residential real estate, hotels, mortgage lending, and meat processing, alleging that the common use of information-sharing software by competitors violates the antitrust laws by facilitating “algorithmic price fixing.” This program provides background on those litigations, analyzes the legal framework under which they arise, and discusses their potential impact on both new and established information-sharing practices.
