Detention decisions are often named as the most difficult ones for magistrate judges to make. Magistrate Judges O’Hara and Chung were on opposite sides of the aisle when in practice, but on the bench, they both face this common task. Come and learn how to avoid common pitfalls that practitioners face in detention hearings — including those into which the judges had themselves fallen when in practice — and other preliminary proceedings in front of magistrate judges, such as preliminary hearings. Strong advocacy from both sides produces more just outcomes and, by taking away from this program a solid understanding of the task magistrate judges face in detention hearings, practitioners will be able to aid the Court in arriving at such outcomes.
